Kids Club Liability Waiver & Release

Assumption of Risk & Release of Liability

I, the undersigned parent or legal guardian (“Guardian”), voluntarily grant permission for my child (“Child”) to participate in supervised childcare activities provided by Lōkahi House, including care provided by its volunteers, officers, directors, and representatives.

I understand that participation in supervised childcare activities involves inherent risks, including but not limited to minor injuries, illness, accidents, or unforeseen events. I voluntarily assume all risks, known and unknown, associated with my Child’s participation.

To the fullest extent permitted by California law, I hereby release, waive, discharge, and hold harmless Lōkahi House, its volunteers, officers, directors, agents, and representatives from any and all claims, liabilities, demands, actions, or causes of action arising out of or related to any injury, illness, loss, or damage sustained by my Child while participating in supervised childcare, except to the extent caused by gross negligence or willful misconduct.

Onsite Parent / Guardian Requirement

I understand and agree that a parent or legal guardian must remain onsite at all times while my Child is participating in supervised childcare at Lōkahi House. I acknowledge that Lōkahi House is not providing licensed childcare services, and that supervision is limited to the duration of the program or event while the parent or guardian remains present at the location.

Medical Notification (No Authorization to Treat)

I understand and agree that Lōkahi House does not provide medical care and is not authorized to consent to medical treatment on behalf of my Child.

If my Child requires medical attention or shows signs of illness or injury, the Lōkahi House childcare supervisor will immediately notify the onsite parent or legal guardian, who will assume full responsibility for all medical decisions and care.

California Civil Code §1542 Waiver

I understand that California Civil Code §1542 states:

“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor or released party.”

I expressly waive and relinquish all rights under California Civil Code §1542 and any similar law, whether known or unknown, arising from my Child’s participation in supervised childcare activities at Lōkahi House.
